Brochure

All information given in the Brochure is based on the information available at the time of publication. Furthermore, Brochures may be printed several months in advance and the content may not always be fully updated. Tibro therefore requests the Client to confirm the current information by contacting Tibro. Tibro reserves the right to change any information contained in the Brochure before or after booking the train journey tour due to any event(s) beyond the control of Tibro.

Some specific terms and conditions are mentioned against the respective train journey tour itinerary in the Brochure/website. Those terms and conditions also form part of the booking terms and conditions. No claim of the Client against any change in the Brochure regarding the train journey Tour shall be entertained and Client acknowledges that such changes are due to reasons beyond Tibro’s control. Tibro takes reasonable care in preparing the Brochure and describing the services therein. However, Tibro is not liable for any typographical / printing errors in the Brochure.

MEALS AND SPECIAL REQUESTS

Tibro cannot guarantee the quality of the food as may be provided by the service provider. In the event that the Client is not able to avail the meals in the menu for any reason attributable to the Client, no claim can be made for the unutilized meal against Tibro. Client acknowledges that train worldwide serve breakfast at a certain time as per their internal policies, and train do not pack and deliver breakfast. The meal has to be consumed when served. If the Client misses any meal due to him/her catching a flight or any other reason, no claim for the same shall be entertained by Tibro. Tibro may, in its sole discretion, entertain the requests for special meals / room allocations subject to such requests given in writing by the Client. TIBRO would take all the necessary steps to ensure that these special requests are honoured. However, in the event that such special
requests are not honoured, Tibro would not be liable for any claim in this regard by the Client. Extra cost, if any, for special meals have to be borne by the Client. Parents are advised to bring special food for their baby with them, as this is not always available locally. Client shall be responsible to bear the additional charges of any special meal if purchased by him/her and shallnot be entitled to recover the same from Tibro.

TRAIN / TRAIN CABINS

The Client would be liable for any damage(s) caused by any act of him/her (willful/negligent) to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned Indian Rail. Tibro would not in any way intervene in the same and will not be liable to the hotel for any act done by the Client. 

Client shall be responsible for his/her own baggage and valuables and Tibro shall not be liable for any loss of baggage or theft of Client’s articles during their stay in the hotels or any time during the tour. Some train may offer the facility like safe deposit lockers, which can be availed of by the Client at its own cost and risk. Tibro will not be liable for any loss/theft from the same.

Any request such as interconnecting rooms, adjustment rooms, rooms on same floor, one king size\one double bed\twin bed, early check in, late check out, smoking\non-smoking etc is subject to availability on first come first serve basis at the hotel and it is totally discretionary and
up to the train authorities to assign. Tibro can only try to request the authorities to cater to such requests on best effort basis, and it cannot be held liable if the same are not provided. If the client seeks a change in rooming while on a tour, the same will be subject to availability and the
client will need to pay any additional charges as may be applicable. Ÿ Facilities like mini bar, pay television channels, telephone, internet etc may not be complimentary. These facilities will have to be paid by the Client directly to the hotel and such charges are not included in the Tour Cost if used by the Client. (Suite and PS have Minibar facility).

ITINERARY

Tibro shall provide a proposed itinerary to the Client before the booking which shall be subject to reasonable change for reasons. The proposed itinerary is only tentative and only the booking details and hotel vouchers sent to the Client before departure shall be final.

The train journey tour price is subject to increase without any notice. If this rate substantially changes prior to departure, the Client would be required to pay such increase in the Tour Cost before the departure.

Tibro takes all reasonable and necessary steps at the time of finalising the itinerary for the Client to ensure that the itinerary is as per the convenience and comfort of the Client. However, in the event of a change in the itinerary, Tibro would take all reasonable efforts to inform the Client
accordingly before the departure of the Client on the train journey tour. 

Further, in the event of a change in the itinerary beyond the control of Tibro in the itinerary of the Client post departure for train journey tour, Tibro or its local partner will make reasonable efforts to inform the client accordingly as and when such a change occurs. Tibro shall not be held responsible in any manner whatsoever for any loss that a Client might suffer consequent to such a change and Tibro solicit Client’s full co-operation in accepting such circumstantial changes. Therefore, no grievance regarding any itinerary / service change which TIBRO is constrained to make, will be entertained from the tour participants during or after the tour. Ÿ The drivers of the coaches are bound by specific rules like maximum driving hours within a day/during a week, rest period per day/week etc. Clients will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel. In the event that any of the sightseeing schedules is missed due to delays caused by the Client, the same will not be refunded to the Client under any circumstances. Ÿ Tibro shall always provide a consolidated invoice (not a break-up) of the entire tour cost. Ÿ In the event of breakdown of any coach or any vehicle arranged for transportation, Tibro will provide an alternative within reasonable time. Tibro shall not be liable for any delays occurred due to breakdown or traffic jam or for any reasons causing delay in the provision of alternative coach/ vehicle. Ÿ Any additional cost incurred by Tibro, for the services provided to the Client, during any force majeure event, shall be paid by the client

COACH / SITTING

On the train journey tours, local ground surface transportation is used for transfer purposes  including local sightseeing. There are no seat numbers allocated and the Clients shall follow instructions of the Indian railway tour manager/guide in this regard. In case the Client is carrying any valuable personal belonging, it is advisable not to leave thembehind at the time of disembarking/leaving the coach. Tibro will not be held responsible or liable in case of loss of such items from the coach.Please note that smoking and consumption of alcoholic beverages is strictly prohibited on coaches / cars. Please keep the coach / cars clean to avoid discomfort to yourself and other tour participants. Any damage caused to the coach during travel as a consequence of the actions of the Client (willful/negligent), shall be payable by the Client and Tibro would in no manner whatsoever be liable for the same.

BOOKING COST

Tibro shall always provide a consolidated invoice (not a break-up) of the entire tour cost.

TIPPING

Tipping is customary in all parts of the world for services rendered. This is however solely at the discretion of the Client

INCLUSION / EXCLUSION

The inclusion and exclusion of the train journey tour will be as indicated in Brochure & itinerary at time of confirmation of tour. Any addition or deletion of services will incur appropriate charges which Client needs to pay over & above the Tour Cost.

ACCOMMODATION FOR CHILD BELOW 12 YEAR OF AGE
Unless the Child shares the bed with the parents, 50% of Adult Cost will be applicable.Infant 0-2 Years are allowed on the train, sharing the same bed with Parents. NO Rollover Beds or Additional Bedding will be available.
NUMBER OF DAYS OF THE TOUR

The days and nights as per the itinerary are decided as per the availability of hotels and airlines.
No claims regarding full utilization of last day or inclusion in the tour shall be valid.

SCOPE OF ACTIVITY

Tibro does not control or operate any airline. It does not own or control any shipping company, coach or coach company, train etc or any other facility or service mentioned in this Brochure. Tibro shall not be responsible for any delay, improper services provided by any agency, airline, transport, hotel, any provider of services, for any injury, death, loss or damage which is caused by the act or default of the management or employees of any hotel, airlines, shipping companies, cruise, coach owners/coach operators/tour operators who are Tibro’s independent contractors.

Tibro shall not be responsible for any delay or deficiency in services provided by any agency, airline, transport, hotel, any provider of services, and/or any act or actions of co-travelers, copassengers which may result in injury, damage to the life/limb or property of the Client or interfere with enjoying or availing the services to be provided on the train journey tour.

HEALTH AND INSURANCE

It shall be the duty of the Client to inform Tibro, prior to departure of a tour in case the Client has any medical history that may affect his ability to enjoy and fully pursue the train journey Tour and wherein the interest of the group or any member thereof is prejudicially affected.

Tibro reserves the right to ask the Client to provide written certification of his medical fitness before departure to the tour. In the event that a medical condition has not been disclosed, Tibro shall not be liable in any manner to provide any assistance or refund the money to the client.

It is mandatory that the Client is adequately covered by appropriate insurance policies from reputed Insurance Company to cover the risk of life, limb and property while on train journey tour. Tibro would in no way be responsible for any loss of life or property in any manner whatsoever.

The tour cost would not necessarily include the costs towards the insurance premium. Hence, it is advisable that the Client gets insurance cover at their own costs.

In case of any medical emergency to the Client during the tour, Tibro shall make best effort to provide medical assistance or arrange for travel back home for the said Client. Client agrees that in the event that the Client is unable to utilize the remaining tour due to sudden illness, he/she shall not be entitled to recover refund for the unutilized part of the tour. In case of any assistance or arrangements for travel back home is to be arranged, the same shall be at an extra cost.

 

CANCELLATION / REFUND

Event / Situation Policy
Natural calamity or unforeseen 1. A service fee of INR 15000 per person will be charged event and balance will be refunded
2. We can shift you on an alternate departure (subject to the situation)

 Guests detected with COVID 19 Name change will be allowed along with the Medical record of the passenger detected with Covid 19. Failure to provide a name change will be considered as no show and 100% cancellation will be applicable. Ÿ General Cancellation / on Show 100% cancellation and will be applicable.

CONDITIONS OF TRAVEL

 Each of these conditions shall be severable from the other and if any provision be invalid, illegal or unenforceable, the remaining provisions shall nevertheless have full force and effect. No liability on the part of Tibro arising in any way out of the Contract in respect of any tour, holiday, excursion facilities shall exceed the total amount paid or agreed to be paid for the train journey tour holiday, and shall in no case include any consequential loss or additional expense whatsoever.

If no suit/action is brought against Tibro within one week of the last day of the train journey Tour, Tibro shall be discharged from all liabilities under/or arising out of this contract and the Client shall be deemed to have relinquished/abandoned all his rights under or arising from this contract.

 If the Client books with a travel agent and such booking with that agent includes, but is not limited to Tibro arrangements, the contract is with Clients’ travel agent and Tibro is a supplier to Clients’ travel agent. The Client cannot in any circumstances make any claim directly to Tibro.

LIABILITY

Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and/or damage or any kind of theft howsoever caused.

Any act, omission, default of any independent contractor or other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the Client or for any person traveling with him howsoever caused.

The temporary or permanent loss of or damage to baggage or personal effects howsoever caused including willful negligence on the part of any person.

Loss of baggage by the train. Over booking of seats by the airline.

Failure on the part of airline to accommodate passengers despite having confirmed tickets or change of route.

Tibro shall not be responsible and / or liable for any damages caused to the Client due to reasons beyond the control of Tibro (Force Majeure / Vis Majeure).

LAW & JURISDICTION:

For all complaints, suits, claims or disputes of whatsoever nature relating to any products the courts and tribunals in Mumbai (India) shall have exclusive jurisdiction. All tours are subject to laws, rules of Reserve Bank of India / Government of India. The Client shall also refer and abide by the terms and conditions as mentioned in the ‘User Agreement’ and Privacy Policy available on www.tibro.in to the extent those terms are applicable to the current transaction.
